FULL DAY PRE-CONFERENCE WORKSHOP LED BY FIDIC EXPERTS

AISHA NADAR, DADUNA KOKHREIDZE, SIMON WORLEY AND DAVID BROWN

The workshop will precede the ICC-FIDIC ANNUAL JOINT CONFERENCE ON INTERNATIONAL CONSTRUCTION CONTRACTS & DISPUTE RESOLUTION to be held in Tbilisi, Georgia on 20-21 September. 

The 19 September workshop offers the first-hand knowledge on FIDIC 1999 Rainbow Contracts and an update on 2017 editions from the FIDIC drafters and experts. The workshop provides an insight knowledge on FIDIC Red, Yellow and Silver Books, addressing its main features, the contract administration, the role of the engineer, and the dispute resolution mechanisms. It also covers contracting with the engineer and provides an overview of the FIDIC White Book. The workshop includes interactive exercises to engage the participants.

ABOUT THE WORKSHOP SPEAKERS

AISHA NADAR

For over 25 years, Aisha has been actively involved in all phases of the negotiation and implementation of large-scale cross-border infrastructure and defense programs. Her procurement and international contract management experience includes holding senior level positions in the US, the Middle East and Europe.

Aisha joined Advokatfirman Runeland as a contract and dispute resolution consultant in September 2012, where she regularly advises clients on strategic procurement planning, contract drafting, contract management and dispute resolution. She acts as arbitrator, mediator and adjudicator and is retained regularly by parties, party counsel and arbitral tribunals in matters involving international arbitration, mediation and dispute boards.

She has experience with ICC, LCIA, SCC, DIAC, UNCITRAL and FIDIC rules. She has carried out assignments related to dispute resolution for organizations such as the World Bank, USAID and US DoD. Aisha is a regularly invited speaker at universities and specialized conferences on construction contracts and dispute resolution.

Aisha currently serves as a member and a principal drafter of FIDIC's Update Task Group updating the FIDIC 1999 Conditions of Contract for major works and as the Special FIDIC Procurement Advisor on Multilateral Development Bank matters. She is an officer of the International Construction Projects Committee of the International Bar Association.

Aisha's educational background includes an LL.M. in International Commercial Dispute Resolution (Queen Mary, University of London), an MBA (University of Texas-Austin) and a BS Electrical Engineering (University of Nebraska-Lincoln).

DADUNA KOKHREIDZE

Daduna Kokhreidze is a Partner at a law firm Nodia, Urumashvili & Partners and leads construction law practice of the firm. She is the President of the Georgian Association of Consulting Engineers ACEG – FIDIC National Member Association. 

Daduna specialises in construction law and dispute resolution and deals with construction disputes and construction contracts. She has been involved in major infrastructure projects in Georgia, advising on procurement, drafting and negotiating construction contracts, on dispute avoidance and dispute resolution in all forms including litigation and arbitration. Daduna has extensive experience in the use of the FIDIC Contracts and is experienced in resolving FIDIC disputes as a DAB member. She is the translator and legal reviewer of the official translation of the FIDIC Red Book to Georgian language.

Daduna has a MSc in Construction Law and Dispute Resolution from King’s College London, is a Fellow of the Chartered Institute of Arbitrators and an Overseas Member of the Construction Law Society of UK (SCL). She is a newly elected board member of Georgian Law Firms Association and a founding member of ACEG and Georgian Arbitrators Association (GAA). She has lectured at CIArb Member Qualification Course and FIDIC accredited trainings on FIDIC Contracts in Georgia. She also lectured Construction Law to LLM students.

SIMON WORLEY

Simon has extensive experience in construction and construction supervision spanning his entire career, including having been the FIDIC Engineer on some 30 international contracts, and is viewed as an expert on the role of the Engineer under the FIDIC Conditions.  He is particularly familiar with and has substantial experience in all aspects of claims and disputes (including avoidance, negotiation and settlement) under the FIDIC ‘Construction’ and ‘Plant & Design-Build’ 1999 editions of the Conditions of Contract.  He advises both Contractors and Employers on claim, dispute, adjudication and arbitration matters, as well as advising Consulting Engineers on Contract Administration best practice.  It has often been commented that “he brings a refreshing touch of realism and practicality” and “is skilled at resolving disputes efficiently”.  He is also an adjudicator.

A University Degree qualified UK Chartered Engineer with 30 years of professional experience, of which the last 25 years have been entirely in the international arena, working for Consultant, Client and Contractor organizations as well as directly for International Financing Institutions such as EU, EBRD, IDB, CDB and KfW.  He is currently Managing Director of EIA Ltd, a UK company founded in 2000.

He has worked in various capacities in some 30 countries in Africa, Asia, the Caribbean, Europe and the ‘Near’ and Middle East, and predominantly on projects funded by the EU, EBRD, KfW, CDB, IDB, AfDB, JICA, World Bank and ADB.

He was the Task Group Leader and Principal Drafter of the FIDIC Updates Task Group (TG6B) preparing the 2nd Edition of the FIDIC Conditions of Contract for Construction (‘Red’ Book) and Conditions of Contract for EPC/Turnkey Projects (‘Silver’ Book) published in December 2017.  He is also a member of the FIDIC Task Group TG9, preparing the new ‘Conditions of Sub-Contract for Design and Build’.

Simon is also a FIDIC international accredited trainer.

DAVID BROWN

David's experience covers the fields of energy, infrastructures and services, and more recently, the nuclear industry.

His experience in dispute resolution namely includes international arbitration (particularly ICC arbitrations), in which he acted as both counsel  and  arbitrator  in construction matters as well as in many commercial matters. He is also actively involved in "dispute boards" proceedings and speaks at many symposiums on the resolution of international construction disputes, in Europe and the rest of the world.                                                                                                                   .

David is listed in Who's Who Legal as one of the most prominent lawyers in the construction field and is recommended by "European legal Expert" for dispute resolution. He is also listed in the "PLC Cross-Border Construction and Projects Handbook" as a "renowned practitioner" in complex international cases.

He has recently been appointed to the French list of FIDIC adjudicators for international project disputes.

CANCELLATION AND REFUNDS

Refunds (less 20% charge to cover administration and tax-related costs) will be made for cancellations received in writing no later than 30 days before the event. After this date it is regretted that refunds of fees will not be made. Participant substitutions can be made at any time.

It may be necessary for reasons beyond the control of ACEG and/or FIDIC to change the contents or timing of the programme, the speakers, the date or the venue. In the unlikely event of the programme being cancelled by the organisers, we will automatically make a full refund.
